General terms and conditions of sale.
The purpose of the present general conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by CYCLO-SYSTEM to the consumer.

Pricies
The prices on the products of this site are valid for any online purchase or order by phone and secure online payment (BNP PARIBAS bank) by credit card, bank transfer and check only.
The customer guarantees CYCLO-SYSTEM that he has the necessary authorizations to use the method of payment chosen by him, when validating the order form.
By order, we mean any order concerning our products appearing on our price list, and accepted by CYCLO-SYSTEM, accompanied by the payment.
The customer must verify the content of the order confirmation and immediately notify us in writing of any error, otherwise the order is valid. The transmitted orders are irrevocable for the customer, unless CYCLO-SYSTEM accepts them in writing.
The delivered products may differ slightly from the ordered products, without prior notice, due to the permanent evolution of the products. CYCLO-SYSTEM guarantees in this case at least equivalent functionality and performance. Failing this, the order is cancelled, without compensation.
The price charged to the client is the price indicated on the order confirmation sent by CYCLO-SYSTEM expressed and payable in Euros whatever the country of origin of the client. The prices of the products, the related taxes, shipping costs, are indicated on the invoice. The prices can be subjected to modifications without notice because of the constant variations of the exchange rate and the tariffs of transport, and in the proportion of these variations.
In case of an order to a country other than metropolitan France, the customer is considered as the importer of the product(s) concerned. For all products shipped outside the European Union and DOM TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall under the jurisdiction of CYCLO-SYSTEM. They will be at your charge and are your entire responsibility both in terms of declarations and payments to the authorities and competent bodies of your country.
All orders are payable in full at the time of ordering unless otherwise specified.
The products remain the property of CYCLO-SYSTEM until full payment of the price. The order validated by the customer is considered effective only when the banking payment centers have given their agreement for the debit on the customer’s account. In case of refusal of the said centers, the order is automatically cancelled and the customer is informed by email or other.
Customer’s own obligations
The customer is responsible for his own choice of products and their suitability for the purpose for which they are intended, for his telephone and postal charges when he contacts CYCLO-SYSTEM, for the taking of instructions, for the maintenance and assembly of the products on his bicycle, for the regulatory declarations incumbent upon him.
Due to the characteristics of the products, the customer considers himself sufficiently informed to not need any other advice than that usually provided by telephone. Any customer buying by mail order (mail, fax, Internet) considers that he does not need any advice and refrains from any grievance related to the duty of advice towards CYCLO-SYSTEM.
Litigation
This contract is subject to French law and to the sole jurisdiction of the Commercial Court of ANNECY. The Vienna Convention on Contracts for the International Sale of Goods is not applicable to this contract.
Field of application
Any order of products implies the acceptance without reserve by the buyer and his full and complete adherence to the present general conditions of sale which prevail over any other document of the buyer, and in particular over any general conditions of purchase, except in the case of an express and prior derogatory agreement of CYCLO-SYSTEM.
The present general conditions of sale apply to all sales of products, manufactured or assembled by CYCLO-SYSTEM, as well as other products distributed by its intermediary, except for particular conditions granted in writing by CYCLO-SYSTEM to the purchaser and this from the date of signature of the order form until the extinction of the guarantees.
Any other document than the present general conditions of sale has only an informative and indicative value, not contractual.
Consequently, the customer recognizes to be perfectly informed of the fact that his agreement concerning the contents of the present general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order on line the products presented within the framework of the store of the Web site. The customer has the option of saving or editing these general conditions, it being specified that both the saving and editing of this document are the sole responsibility of the customer, these general conditions of sale may be subject to change. In this case, the general conditions will be those in force on the site at the date of the order. The customer declares to have the full legal capacity allowing him to commit himself under the present general conditions.
Ordering
Validation of orders and electronic signature (law of March 13, 2000 on electronic signature).
Any order form signed by the consumer by “double click” constitutes an irrevocable acceptance which can be called into question only in the cases restrictively provided for in the present general conditions of sale. The “double click” associated with the authentication and non-repudiation procedure and the protection of the entirety of the messages constitutes an electronic signature. This electronic signature has value between the parties as a handwritten signature.
CYCLO-SYSTEM presents on its website the products to be sold with the necessary characteristics to respect the article L 111-1 of the Consumer Code, which allows the potential consumer to know before the final order the essential characteristics of the products he/she wishes to purchase.

It is up to you to check with the local authorities the possibilities of importing or using the products you are considering ordering.

CYCLO-SYSTEM cannot be held responsible for the non-execution of the contract in case of stock shortage or unavailability of the product, force majeure, disturbance or total or partial strike of the postal services and means of transport and/or communications, flood, fire.
